Transaction associates are NOT required to tell you they are Transaction associates or to disclose to you in writing because, they DO NOT represent you, the buying customer. When a buyer agrees to work with a Transaction associate they give up undivided loyalty of the agent and their broker. The Transaction associate will help by assisting both the buyer and seller, but is not suppose to represent one party to the detriment of the other. Unlike States with Dual Agency where the buyer and seller are represented by the same agent, and the brokerage firm has liability, the buyer or seller can sue the broker if they are misrepresented or treated unfairly. Florida has remove the liability from real estate firms in this State by creating Transaction Brokerage. To date no Transaction Broker has been held liable for misrepresentation, because they do not have to disclose to the buyer that they DO NOT represent the buyer.
BUYER BEWARE: If you search FLORIDA BUYER BROKER on the internet. Click on AGENT FINDER BUTTONS or SEARCH LINKS on many 3rd party websites, including YELP, the search will produce hundreds, if not thousands of Transaction associates using the Tradename FLORIDA BUYER BROKER. Those agents DO NOT WORK for FLORIDA BUYER BROKER and most of their brokers do NOT allow buyer representation. There is at least one man, who does not have a estate license using FLORIDA BUYER BROKER as his screen name on a popular 3rd party property searching website.
